REGULATIONS (hereinafter referred to as the "Regulations")

DEFINITIONS
The terms used in the Regulations mean:
3G VISION SP. Z OO – 3G VISION Sp. z o. o. with its registered office in Ząbki 05-091, at ul. Gajowa 1A, KRS0000844854, NIP 125-170-62-29, REGON 386234492
WEBSITE – the website at www.fendaleyewear.com
ONLINE STORE – an online sales service operated by 3G VISION SP. Z OO, available to Customers, where Customers can purchase Goods. The Online Store is available at www.fendaleyewear.com
CUSTOMER – a natural person or legal entity concluding a sales contract
CONSUMER – a natural person concluding a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity, within the meaning of Article 22(1) of the Act of 23 April 1964 – the Civil Code
CUSTOMER ACCOUNT – a set of services and functions available to the Customer after registering and logging in to the Store, as well as a set of Customer data and settings related to the use of the Store;
GOODS – a product offered to the Customer by 3G VISION SP. Z OO via the Online Store;
PRICE – the value of the Goods expressed in monetary units, which the Customer is obliged to pay to the Seller;
ORDER – sending by the Customer to the Online Store a duly completed order form available on the Website, indicating, among other things, the Customer’s data and the Goods that the Customer intends to purchase in the Store;
TRANSACTION – the Customer purchasing Goods from the Online Store in accordance with the provisions of these Regulations, based on the placed Order;
PAYMENT – the Customer’s monetary payment made in connection with the Transaction;
NEWSLETTER – Electronic Service that enables all subscribers to receive periodic information about the Online Store to the e-mail address provided by the Customer, regarding Goods, marketing campaigns and promotional campaigns;
ELECTRONIC SERVICE - provision of services by electronic means in accordance with the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended), by the Seller to the Customer via the Online Store;
OPINION – Electronic Service enabling the Customer to post an opinion on the Website regarding the Goods purchased in the Store;
DIGITAL CONTENT – data provided by the Customer in digital form;
REGULATIONS – these regulations.


I. GENERAL PROVISIONS
1) 3G VISION SP. Z OO provides services within the so-called Web-ordering in accordance with the Regulations.
2) Customers may use Web-ordering only under the terms and conditions set forth in these Terms and Conditions. The Customer confirms that he or she has read the Terms and Conditions.
3) Customers may not provide content within the framework of Web-ordering that is illegal or contrary to good practices or principles of social coexistence, in particular they may not post content that infringes the rights of third parties, including their copyrights and personal rights.
4) Web-ordering offers Customers the ability to browse Goods, purchase Goods, deliver Goods and other functionalities described below in the Regulations.
5) Images of the Goods are examples and are for presentation purposes only. Images and descriptions below individual Goods are provided by manufacturers, distributors, or third parties. Actual Goods may vary in color and shade.
6) 3G VISION SP. Z OO will make every effort to ensure the security of data within the Web-ordering system and will ensure that the Online Store operates continuously and correctly.

II. CREATING AN ACCOUNT AND LOGGING IN
1) In order to create an account, please complete the registration form on the website www.fendaleyewear.com, providing the following data: e-mail address and password;
2) The condition for registration is to read and voluntarily accept these Regulations, as well as to consent to the processing by 3G VISION SP. Z OO of personal data necessary for the fulfillment of Orders placed in the Online Store;
3) After completing the registration form, complete the registration process by sending the completed form;
4) After registration, the Customer may log in to the Online Store using the email address provided during registration as a login and password;
5) The customer is obliged to regularly update the data contained in the registration form.
6) Registration is not a necessary condition to make a purchase at www.fendaleyewear.com.
7) 3G VISION SP. Z OO reserves the right to discontinue the provision of services by blocking the Account of a Customer who grossly or persistently:
a) engages in activities that may hinder or destabilize the operation of the Online Store,
b) acts to the detriment of 3G VISION SP. Z OO by undertaking actions contrary to these Regulations,
c) refuses to accept the Order or to make payment for the Order in accordance with the provisions of these Regulations.

III. ORDER PROCESSING
1) The purchase of Products is possible:
a) after creating or logging in to the Customer Account or
b) after the Customer provides the following data in the Online Store: first name, last name, residential address (in the case of a natural person) or company name, contact address (in the case of a legal person or an organizational unit without legal personality), delivery address, if it is different from the residential address or contact address, as well as telephone number, e-mail address.
2) Placing an Order in the Store and concluding a contract takes place by performing the following actions, subject to paragraph 2:
a) adding Products to the cart,
b) acceptance of these Regulations,
c) acceptance of the content of information on the processing of personal data,
d) choosing the form of delivery of the Order
e) selecting the form of payment for the Order and its delivery.
Fulfillment of the order shall be understood as the delivery of the ordered Goods to the Customer.
1) The customer specifies the place of delivery in the Order form.
2) Orders will be processed within 1-4 business days from the date the order is accepted. Order deliveries will be made on business days, defined as Monday through Friday, excluding public holidays.
3) 3G VISION SP. Z OO delivers the Goods to the Customer together with a sales document in the form of a fiscal receipt or VAT invoice (at the customer's request).
4) After the Goods are released by the delivery company, the Customer should check whether the Goods have no mechanical damage caused during transport and whether the released Goods are consistent with the Order.
5) If the goods are found to be mechanically damaged or inconsistent with the order, the Customer is entitled to exchange the goods or submit a complaint. Filing a complaint does not release the Customer from the obligation to pay the full value of the order.
6) In the event of an unjustified refusal to accept the ordered goods, the Customer will be charged for shipping costs. The Customer is obligated to cover any damages associated with the unjustified refusal to accept the ordered goods.
7) In the case of cash on delivery, 3G VISION SP. Z OO reserves the right to charge the Customer for the shipping costs of an Order that has not been collected by the Customer, regardless of the order amount, and to charge the shipping costs in the event of re-sending a package that has not been collected previously.
8) 3G VISION SP. Z OO reserves the right to block the customer's ability to use Web-ordering or to withdraw from the order after informing the customer thereof, in particular when the order was placed:
a) if there is a suspicion that the customer's account is being used by third parties or unauthorized persons;
b) in violation of the Regulations.

IV. ONLINE STORE AND CUSTOMER SERVICE
1) The online store is open 24 hours a day.
2) By placing an Order, the Customer makes an offer to purchase selected Goods at the Prices specified in the Order and undertakes to collect the Goods and pay the order value.
3) Acceptance of the Customer's offer takes place by sending an e-mail by 3G VISION SP. Z OO to the Customer confirming the commencement of Order processing.
4) 3G VISION SP. Z OO reserves the right to withdraw from an Order that has already been placed if it proves impossible to complete (e.g., the ordered Goods were damaged or there was a discrepancy between the warehouse inventory and the warehouse's computer database). 3G VISION SP. Z OO will immediately inform the Customer of this fact by email or telephone.
5) The goods offered in the Online Store are brand new, free from legal defects, and introduced to the Polish market in accordance with applicable law. The company makes every effort to ensure that the goods it offers meet the high quality requirements and standards adopted by 3G VISION SP. Z OO in all forms of sale.
6) Clarification of doubts and irregularities related to the placed Orders or the execution of Transactions is possible from Monday to Friday (excluding public holidays), from 9:00 a.m. to 5:00 p.m. by phone at +48 600 001 431 or by e-mail at hello@fendaleyewear.pl
7) The Company informs that the details of the external appearance of the Goods offered in the Online Store (in particular the colours and shades) visible on the Customer's devices (monitor, display) or on printouts made by the Customer may differ from the actual ones, depending on the individual properties and settings of these devices.
8) 3G VISION SP. Z OO will make every effort to ensure that the descriptions of the Goods correspond to reality and that only Goods available for sale are displayed in the Web-ordering.
9) Product descriptions, prices, and any other information posted on the Website do not constitute an offer by 3G VISION SP. Z OO within the meaning of the Civil Code, but merely an invitation for the Customer to submit an offer. The Customer's offer constitutes an Order.
10) The Customer placing an Order undertakes to pay the Price for the Goods in the amount and within the time specified in the Order.
11) The place of conclusion of the sales contract is the city of Ząbki.

V. GOODS PRICES
1) The Online Store publishes information about its offer on the Website and offers Goods contained in the Online Store database via the Internet.
2) Prices of Goods are displayed next to the Goods offered. Prices include VAT and are given in Polish zloty or, for customers who are not Polish taxpayers, in euros.
3) The binding and final price of the Goods is the price given on the Website at the time of placing the Order by the Customer.
4) 3G VISION SP. Z OO reserves the right to make ongoing changes to the Prices of the Goods on offer, as well as to conduct and cancel all types of promotional campaigns and sales. This reservation does not apply to confirmed Orders.
5) The payment operator is PayPro SA with its registered office in Poznań (60-327), at ul. Pastelowa 8, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000347935, NIP 779-236-98-87, REGON 301345068, with the share capital of PLN 5,476,300, fully paid up.

VI. PAYMENT AND DELIVERY METHODS
1) Payment for the Order can be made in cash or by card to the courier upon delivery, in cash upon personal collection at the company's office, online, by Visa, Visa Electron, Maestro, MasterCard, MasterCard Electronic payment cards or by bank transfer to the bank account of 3G VISION Sp. z o. o., mBank - No. 25 1140 2004 0000 3102 8009 5318.

3) After placing the Order, the Customer is obliged to pay the fee in the manner specified in paragraph 1
4) Delivery is made within Poland by the GLS courier company.
5) Detailed information on delivery options can be found on the Website in the "Delivery" tab.

VII. RETURN
1) The Customer has the right to withdraw from the Transaction by submitting an appropriate declaration on the form within 14 days of the date of delivery of the Goods. The declaration of withdrawal from the contract should be sent to the following address:

3) The goods should be returned immediately, no later than 14 days from the date of submission of the declaration of withdrawal from the contract.
4) Goods that meet all of the following conditions are subject to return:
a) the original receipt (document confirming the purchase) is attached to the returned goods;
b) the returned goods have not been used;
c) the returned goods are packed in their original, undamaged packaging and contain all tags and markings;
5) The amount due to the Customer for withdrawal from the Transaction shall be refunded within 14 days from the date of delivery of the declaration of withdrawal from the contract.
6) The customer will receive a refund of the amount due to him to the bank account indicated in the declaration, and in the case of a refund via a quick transfer or payment card, the funds will be refunded to the bank account linked to the above-mentioned payment method.

VIII. EXCHANGE

1. The Customer has the right to exchange the purchased Goods within 14 days from the date of delivery of the Goods.
2. To exchange the Goods, the Customer must place an order for the exchange Goods via the Online Store, entering the words "EXCHANGE GOODS" in the order comments. After placing the Order, the Customer is obligated to return the Goods within the timeframe specified in point 1 to the following address:

4. Goods that meet all of the following conditions are subject to exchange:
a) the returned goods have not been used;
b) the returned goods are packed in their original, undamaged packaging and contain all tags and markings;
5. If the Goods returned as part of the exchange meet the conditions set out in section 3, delivery of the Goods ordered as part of the exchange will be made within the deadlines set out in section 4.
6. If the Goods do not meet the conditions set out in paragraph 3, the Goods ordered for replacement will not be sent to the Customer, and the Goods sent by the Customer for replacement will be sent back to the Customer at his expense and risk.

IX. COMPLAINT
1) Complaints should be submitted to the following address: 3G VISION SP. Z OO, Gajowa 1A, 05-091 Ząbki, with the note "REKLAMACJA".
2) When submitting a complaint, please provide 3G VISION SP. Z OO with the product in question, along with proof of purchase and a description of the complaint.
3) 3G VISION SP. Z OO will consider the complaint within 14 (fourteen) days from the date of receipt of the complaint document together with the Goods subject to the complaint.
4) If the complaint is considered in favor of the Customer, 3G VISION SP. Z OO will repair or replace the complained goods with new, full-value goods or refund the value of the purchased goods.
5) The Seller is liable under the warranty if a physical defect is discovered before the expiry of two years.
6) If the buyer uses the warranty, they may demand compensation for any damage they suffered as a result of concluding the contract without being aware of the defect. In particular, they may demand reimbursement of:
7) costs of concluding the contract,
8) costs of collecting, transporting, storing and insuring the goods,
9) expenditure made to the extent that he did not derive any benefits from these expenditures
10) The Buyer may, under the warranty:
a) request a price reduction,
b) demand the replacement of the defective item with a defect-free one,
c) demand the repair of the goods,
d) withdraw from the contract and demand a refund.
11) In the case of the last solution, the refund is not due if the defect is insignificant or the seller immediately replaces the defective item with a product that complies with the contract or removes the defect.

X. FREE SERVICES
1) The Seller enables Customers to conclude an agreement for the provision of Digital Content via the Newsletter:
a) Concluding a contract for the supply of Digital Content by providing a valid e-mail address in the form on the Website and confirming it by clicking on the link in the e-mail received from the Seller;
b) Using the Newsletter service does not involve the payment of any amount. The fee paid by the Customer for the delivery of Digital Content consists of their personal data and voluntary consent to subscribe to the Newsletter;
c) Once the Customer confirms the Newsletter subscription in the manner specified above, the agreement for the supply of Digital Content is effectively concluded;
d) You can unsubscribe from the Newsletter service at any time by re-entering your email address in the form on the Website.
2) The Customer has the option of posting an Opinion on the Website:
a) Providing Opinions is voluntary;
b) The opinion may only concern the completed Order placed in the Online Store;
c) Opinions submitted by the Customer are published by the Seller in the Online Store and on the TrustMate.io business card;
d) The Opinion may not be used for illegal activities, in particular for activities constituting an act of unfair competition towards the Seller, or for activities infringing personal rights, intellectual property rights or other rights of the Seller or third parties, and may not contain illegal content or confidential data;
e) The Seller shall not be liable for any damage resulting from the content of Opinions issued by the Customer;
f) The submitted Opinion may be deleted at any time by the Client who is its author.


XI. PERSONAL DATA

1) The controller of the Customer's personal data is 3G VISION SP. Z OO with its registered office at

2) Personal data are used by 3G VISION SP. Z OO for the following purposes:
a) execution of official orders by employees of 3G VISION SP. Z OO;
b) marketing of own products or services in order to present an appropriate offer, based on the legitimate interest of the data controller, until the Customer objects to the processing of personal data for this purpose. The legitimate interest is the direct marketing of its products by 3G VISION SP. Z OO. For this purpose, the following data will be processed: first name, last name, contact details, and sales history.
3) Providing data is voluntary, but necessary to conclude a sales contract and perform related activities;
4) The customer has the right to:
a) access to the content of your data, request from the Controller their rectification, deletion, restriction of processing, data transfer;
b) withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal,
c) object to the processing of your personal data for direct marketing purposes by 3G VISION SP. Z OO
d) lodge a complaint with the supervisory authority if the Client considers that the processing of personal data concerning the Client violates the provisions of the GDPR;
5) The data provided will be processed on the basis of Article 6 paragraph 1 point b) and f) of the General Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR);
6) The Customer's personal data will be stored for the period necessary to perform the sales contract and until the expiry of the limitation periods for claims;
7) The Customer's personal data is not subject to automated decision-making, including profiling;
8) In all matters relating to the processing of personal data, in particular the exercise of rights related to data processing, objections, transfer of data outside the EOD area, you can contact the Personal Data Controller:

9) The data of the Customer who has created an account on the Website or placed an Order are processed to the extent necessary to maintain the account or execute the Transaction, in accordance with Article 18 of the Act on the provision of services by electronic means (Journal of Laws No. 144 of 2002, item 1204, as amended);
10) Customers who have registered also agree to receive current commercial information regarding promotions and news in the company's offer.

XII. FINAL PROVISIONS

1) In matters not regulated in these Regulations, the provisions of generally applicable law shall apply, in particular the provisions of the Act of 30 May 2014 on consumer rights, the Act of 18 July 2002 on the provision of services by electronic means, the Act of 4 February 1994 on copyright and related rights, the Civil Code and other mandatory provisions of law;
2) The agreement concluded between the Customer and 3G VISION SP. Z OO and any disputes arising from the legal relationship between these entities are subject to Polish law and the jurisdiction of Polish courts;
3) Consumers have the option of using out-of-court complaint and redress mechanisms. Rules for accessing these procedures are available at the offices or on the websites of entities authorized to provide out-of-court dispute resolution. These may include, in particular, consumer ombudsmen or the Provincial Inspectorates of Trade Inspection, a list of which is available on the website of the Office of Competition and Consumer Protection at http://www.uokik.gov.pl/spory_konsumenckie.php. As well as the online dispute resolution platform for consumers and businesses at the EU level (ODR platform), available at: http://ec.europa.eu/consumers/odr/;
4) An entity other than a Consumer or an Entrepreneur with consumer rights does not have the right to withdraw from a distance contract;
5) Any liability of the Seller towards the Buyer who is not a Consumer or an Entrepreneur with consumer rights is excluded;
6) In the event of a potential dispute with a Buyer who is not a Consumer or an Entrepreneur with consumer rights, the court having jurisdiction to resolve disputes is the court having jurisdiction over the registered office of 3G VISION SP. Z OO;
7) All names of the Goods offered for sale by 3G VISION SP. Z OO in the Online Store are used for identification purposes and may be protected and registered under the provisions of the Industrial Property Law Act (Journal of Laws No. 119 of 2003, item 1117);
8) The rights to the content of the Web-ordering website, including the graphic layout, photos, trademarks, logos and other content and elements, are owned by 3G VISION SP. Z OO or entities cooperating with 3G VISION SP. Z OO;
9) It is prohibited to copy, modify or otherwise use the website www.fendaleyewear.com or any part thereof without the consent of 3G VISION SP. Z OO.

XIII. CHANGES TO THE REGULATIONS

1) 3G VISION SP. Z OO reserves the right to amend these Terms and Conditions at any time, with future effect. Notice of any changes to these Terms and Conditions will be sent to the email address provided during login;
2) The change to the Regulations comes into effect on the date indicated in the information about the change to the Regulations;
3) Changes to the Regulations may not violate the Customer's rights arising from Orders placed before the change was introduced.
